Terms and Conditions – Rush SOS

1. Nature of the Organization and Service

Rush SOS is a non-profit initiative whose mission is to facilitate emergency assistance coordination for individuals engaging in adventure and outdoor activities.

For practical reasons, during the pilot period the service is operated by AMAI bvba, a company incorporated in Belgium, which is the contracting party for the logistics fee and these terms. After the pilot, Rush SOS will be established as a Brazilian non-profit organization (associação sem fins lucrativos).

Rush SOS is not an insurance company, does not underwrite risk, and does not replace travel, health, or evacuation insurance. Any references to insurance relate solely to third-party providers and are limited to facilitation or verification, where applicable.

2. No Guarantee of Rescue – Best Effort Basis

All services provided by Rush SOS are offered strictly on a best-effort basis.

• Rush SOS does not guarantee rescue, evacuation, medical assistance, transport, or response time.
• Outcomes depend on multiple external factors, including but not limited to weather, aircraft availability, medical staff availability, location, communications, and third-party providers.
• By using the service, you expressly acknowledge that assistance may not be possible, even after activation.
• Helicopter evacuation is reserved for life- or limb-threatening injuries. The on-call coordinator assesses each call and decides whether an aircraft is dispatched; that decision is final.

3. Eligibility: Insurance, Fee and Wristband

Coverage becomes active only once all of the following are complete:

• A valid travel insurance policy covering Brazil, adventure sports, and at least USD 50,000 in medical costs. The policy is bought and paid for by the user directly with the insurer (around USD 32 for a two-week stay, more for longer stays) and is not part of the Rush SOS fee.
• Payment of the Rush SOS logistics fee, USD 47 during the pilot. The fee covers coordination and the advance of helicopter logistics costs (approximately USD 6,000); it is not an insurance premium.
• An NFC wristband, collected at a participating pousada and linked to the user's profile via WhatsApp.

Coverage lasts for the period shown in the user's insurance policy, and never beyond the pilot period defined below.

4. Covered Activities

Assistance is coordinated for injuries sustained during ordinary tourist adventure activities in the covered area, including kitesurfing, windsurfing, wingfoiling, swimming and beach activities, horseback riding, and quad or ATV tours.

Extreme or high-risk activities outside that scope — such as paragliding or base jumping — and any activity excluded by the user's own insurance policy are not covered.

5. Covered Area and Pilot Period

The first Rush SOS pilot runs from 1 September until 31 December 2026 (inclusive), along the coast of Ceará between Cumbuco and Tatajuba. Coverage applies in that area only, and only within the pilot period.

Wristbands are distributed by the participating pousadas: Outro Beach Club Hotel (Cumbuco), Dom Domar (Ilha do Guajiru), Windhouse (Preá), Flowhouse (Jericoacoara), Vila Kalango (Jericoacoara), Casa Uca (Guriú), 4 Coqueiros (Guriú), Sunset (Tatajuba), Casa Santa Maria (Tatajuba).

6. Service Availability Window

The Rush SOS service is available only under the following conditions:

• Season: From 1 September until 31 December 2026 (inclusive)
• Days: Every day during the season
• Hours: From 10:00 a.m. until 6:00 p.m. (local time)

After 5:00 p.m., users acknowledge and accept that the likelihood of helicopter availability drops significantly, as aircraft capable of flying at night are rare and often unavailable in the covered regions. Any request after this time is treated as highly uncertain.

During the pilot the helicopter is based in Fortaleza, so each village has its own final departure time — the further from Fortaleza, the earlier it is. A request made after the time listed for that village cannot be flown until the next morning. Rush SOS intends to add a helicopter based in Sobral as soon as possible, which would extend these times, but no date is guaranteed.

Rush SOS has no obligation to operate outside these dates or hours.

7. Individual-Based Coverage and Logistics

All logistics coordination, identity verification, and any linked insurance facilitation (if applicable) are strictly tied to one individual only.

• The service is non-transferable.
• Group coverage is not implied unless explicitly agreed in writing.
• Activation for anyone other than the registered individual is invalid.

8. Technical Limitations and Liability

Rush SOS is not responsible for:

• Technical errors, software bugs, network outages, GPS inaccuracies, NFC failures, telecommunications issues, or device malfunctions
• Failures or delays caused by third-party platforms (e.g. messaging services, payment processors, insurers, aircraft operators)
• Incomplete, incorrect, or delayed information provided by the user

The user accepts that emergency coordination depends on complex systems that may fail or degrade without notice.

9. User Responsibilities

By using Rush SOS, the user agrees to:

• Provide accurate, truthful, and up-to-date personal information
• Maintain adequate personal insurance coverage independently
• Understand and accept the inherent risks of adventure and outdoor activities
• Follow instructions from emergency professionals and local authorities, when applicable

10. Limitation of Liability

To the maximum extent permitted under Brazilian law, Rush SOS, its volunteers, partners, and representatives shall not be liable for injury, death, loss, damage, or consequential harm arising from:

• Failure to provide assistance
• Delayed or incomplete assistance
• Actions or omissions of third-party service providers

11. Governing Law

These Terms and Conditions are governed by the laws of the Federative Republic of Brazil, and any disputes shall fall under Brazilian jurisdiction.
